Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and TypeBag ("TypeBag", "we", "us"), the operator of the website at typebag.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if all of the following are true:

• You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher).
• You have legal capacity to enter into a binding contract.
• You are not located in, or a resident of, a Restricted Jurisdiction (defined below).
• You are not on any sanctions list maintained by the United States, the European Union, or the United Nations.
• Skill-based wagering is lawful at your location.

We may verify your identity, location, age, and source of funds at any time. Failure to satisfy verification may result in account suspension and forfeiture of any balances pending review.

2. Restricted Jurisdictions

Access to the Service is blocked from the following jurisdictions:

• Romania, the country in which TypeBag is incorporated.
• Countries, regions, or territories subject to comprehensive economic sanctions, currently including Cuba, Iran, North Korea, Syria, Russia, Belarus, Venezuela, and Myanmar, as well as the Crimea, Donetsk, and Luhansk regions, and any other jurisdiction designated by the U.S. Office of Foreign Assets Control, the European Union, or the United Nations.
• The following U.S. states, where paid skill-based contests are restricted or unlawful under state law: Arizona, Arkansas, Connecticut, Delaware, Louisiana, Montana, South Carolina, South Dakota, and Tennessee.

The list of Restricted Jurisdictions may change without notice. Attempting to circumvent geographic restrictions (e.g., via VPN) is a material breach of these Terms and may result in account closure and forfeiture of disputed balances pending review.

3. Account and Custody

Account creation is performed via Privy. A Solana embedded wallet is created for you on first login. Funds you deposit are held by TypeBag in a pooled, platform-controlled custody wallet on the Solana blockchain. Your on-platform balance is recorded on an off-chain ledger maintained by TypeBag.

The Service is custodial. Once you deposit USDC to the platform wallet, you do not retain direct on-chain control of those funds. You may withdraw any available balance at any time, subject to anti-abuse review windows described below. By using the Service, you acknowledge that the security of your funds depends on TypeBag's operational controls, including the platform wallet's signing infrastructure.

4. Wagering, Stakes, and Payouts

• Stakes are denominated in USDC and offered at fixed tiers (currently $1, $3, $5, and $10).
• A duel pot equals two times the stake. The winner receives ninety percent (90%) of the pot. TypeBag retains ten percent (10%) as a service fee ("rake").
• The winner is determined server-side by the first player to type the entire passage correctly. Server measurements are authoritative.
• If a duel is voided (technical fault, insufficient data, etc.), both stakes are returned to the players in full and no rake is taken.
• Voluntary forfeit, abandonment, or disconnection beyond the grace window awards the pot to the opponent. The rake is still taken.

5. Withdrawals and Holds

Withdrawals are processed on the Solana blockchain. Network confirmation is required before funds appear in your destination wallet. TypeBag may temporarily hold a withdrawal in any of the following circumstances:

• Pending identity, source-of-funds, or sanctions verification.
• Active investigation of a cheat flag, suspected collusion, or anomalous play.
• Reconciliation of platform funds (TypeBag pauses all withdrawals platform-wide while a ledger discrepancy is investigated).
• Compliance with a lawful order, request from a regulator, or law enforcement.

6. Fair Play and Anti-Cheat

You agree to use only your own keystrokes, your own input device, and your own skill. You may not use macros, scripts, autohotkeys, AI assistants, predictive text engines, paste, hardware accelerators, or any other tool or technique that substitutes for human typing. You may not collude with another participant.

TypeBag continuously monitors keystroke timing, words-per-minute, accuracy, and statistical patterns. Suspicious sessions are flagged and may be held pending review. Confirmed cheating results in account closure, forfeiture of disputed pot proceeds, and a permanent ban. Honest balances unrelated to the cheating activity will be returned to the user's designated withdrawal address within thirty (30) days of the closure decision.

7. Prohibited Conduct

• Maintaining more than one account.
• Allowing another person to use your account.
• Using TypeBag if you are excluded from gambling, wagering, or competitive-skill platforms by court order, voluntary self-exclusion, or any other authority.
• Money laundering, structuring, or any use of TypeBag to convert, transfer, or obscure proceeds of unlawful activity.
• Reverse engineering, scraping, or attempting to interfere with the Service's integrity.

8. Intellectual Property

All content, code, branding, passages, and game mechanics are owned by TypeBag or licensed for our use. You receive a limited, revocable, non-transferable license to use the Service for its intended purpose.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, TypeBag and its affiliates are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost revenue, or lost funds caused by blockchain-network failures, signing-infrastructure compromise, RPC outages, force majeure, or third-party service failures. Our aggregate liability for any claim arising from your use of the Service is capped at the greater of (a) the total rake we have collected from your duels in the ninety (90) days before the claim, or (b) US$100.

10. Disputes and Governing Law

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms or the Service shall first be addressed via good-faith negotiation between the parties for a period of thirty (30) days. If unresolved, the dispute shall be submitted to the competent courts of Bucharest, Romania, except where mandatory consumer-protection rules of your country of residence require otherwise.

11. Account Closure

You may close your account at any time after withdrawing your available balance. TypeBag may suspend or close your account immediately for breach of these Terms, suspected cheating or fraud, suspected sanctions or AML risk, or operational necessity.

12. Changes to These Terms

We may amend these Terms from time to time. Material changes will be communicated via in-app notice or email at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
